This song's still under copyright. Can we post on a public forum our versions without permission?

Since we are not gaining any monies from this it should be fine. Technically any hymn in ANY hymnal published in the last twenty years is still under copywrite. Going to be very difficult to get away from. This would include the song we just spent two weeks on.

There shouldn't be any problem, since the tune was written in 1868 and the lyrics in 1865. Also, if I'm not mistaken, the hymnal copyright is given to cover the re-publishing of the text and notation as written in that particular hymnal, not the performance of the tune and lyrics. Your church would probably need a CCLI License if it uses overheads of the lead sheets rather than a hymnal.

In that case, we're more likely to get in trouble over the PDF files than we are the MP3 files, but since you apparently have rewritten and transposed them in Finale Notepad, that makes the PDF your own arrangement, so we're probably safe there, too. If you do actually lift the notation directly from the hymnal, you would need to name your source in that posting.

If any of you are well-versed in music publishing law, and I'm wrong, please set me straight.

No you are correct Brass.. and much better than I did.

You are also correct on the CCLI liscense. Which are costly. We have one as we reprint chorus lyrics in our bulletins.

Performances of any music belong to the performer. However if you you publish said performance on an album you must pay any applicaple royalty/liscense fees. If for example we decided to SELL an album of Exchange songs. We would need to work out any fees.

I bought sheet music to "Gabriel's Oboe" by Morricone (from 'The MIssion".) Would I be able, for instance, to make a recording of me playing that (with my own slight variations--or not) and post it on a place like the clips page here on PWA? Of course, I use this as a case for all the sheet music I might have purchased, but whose tunes are not public domain.

In other words, can I play this, as long as I don't make money off it and/or as long as I don't give other people copies of the music? What's the law?

As far as i know you can. I may be wrong but even if so I doubt anyone will say anything. Since we are not making a dime off of it anyway
